419.09 Revision of Protected Resources, Spousal Share, and Spousal Allowance (AAM)

Recalculate the community spouse ’ s protected resource amount, the spousal share, or the spousal allowance during the first year of eligibility only if one of the following situations occur:

• A new community spouse protected resource amount is set by a court support order;

• Inaccurate information was provided when the spousal share was computed for the first period of institutionalization; or

• based on the findings of a fair hearing through the Department ’ s Office of Fair Hearings.
