311.05 Legal Action Against Liable Relatives (AAM)
311.05 Legal Action Against Liable Relatives (AAM)
SR 25-29 Dated 08/25 Previous Policy
__________________________________________________________________
Refer a case to the District Office Supervisor for review when a liable relative is determined able to contribute and they:
· refuse to contribute, or
· refuse to supply adequate information regarding their ability to contribute.
Do not deny or terminate assistance if the legally liable relative fails to cooperate or contribute support. Based on the facts, the BFA Supervisor may refer the case to DHHS's Counsel for Division of Economic Stability. The Counsel determines if a referral to the Attorney General's Office should be made to pursue legal action against the liable relative.
