002.09(C) BATTERED IMMIGRANTS.

Deeming is exempted for 12 months if: (i) The immigrant, the immigrants’ child, or both were battered; (ii) The battery was committed by a spouse, a parent, or a member of the spouse’s or parent’s family while they are residing together; and (iii) The battered immigrant, child, or parent must no longer reside in the same household as the abuser.
