005.14(B) ADVERSE ACTION.

Adverse action pending an appeal is not carried out if: (i) The case action being appealed required adequate and timely notice; (ii) The applicant or recipient requests an appeal hearing within ten days following the date the notice of finding is mailed; and (iii) The applicant or recipient does not refuse continued assistance.
