ACA/FAMILY MEDICAID 200 Groups Covered-Overview

Supersedes: FMA 200 (01/01/08); Bulletin FMA 73 (04/08/15) Reference: 42 CFR 435.110, .116, .118, .150; 42 CFR 457.310; State Medicaid Director Letter dated May 30, 2014 Overview: Provide Medicaid coverage to the following groups: ACA GROUPS: ACA Parent/Caretaker Relative, ACA Pregnancy, ACA HMK Plus, ACA HMK, and Former Foster Care Children, ACA Adult, and ACA Adult Medicaid. FAMILY GROUPS: Child Newborn, Pregnancy Extended, Child Medically Needy (child who does not live with a parent/specified caretaker relative), Qualified Pregnant Woman, Family Medically Needy (child living with parent/specified caretaker relative), Breast & Cervical Cancer, Subsidized Adoption, IV-E Foster Care and Non-IV-E Foster Care. SAME SEX MARRIAGE: Same-sex couples who marry in a jurisdiction that recognizes same-sex marriage are considered spouses. Same-sex marriages are permissible under Montana law, and Montana recognizes same-sex marriages performed in other jurisdictions. NOTE: Civil unions and domestic partnerships do not impact marital status and therefore these couples are not considered spouses when determining Medicaid eligibility. Effective Date: July 01, 2016
