MISSISSIPPI DIVISION OF MEDICAID Eligibility Policy and Procedures Manual CHAPTER 102 – Non-Financial Requirements Page |53 Effective Month: September 2018 • SNAP (Supplemental Nutrition Assistance Program), • Public Housing or Section 8 housing vouchers, • Cash assistance through SSI or TANF (non-cash TANF benefits exempted). Many aliens establish that they will not become public charges by having ‘sponsors’ who pledge to support them. Aliens may ask staff about the consequences of becoming a public charge by applying for assistance. This is of concern to aliens who want to become Legal Permanent Residents and obtain a Green Card. It should be noted that the public charge rule does not apply to: • refugees and persons granted asylum with pending or approved applications for status, • Victims of Trafficking, or criminal activity or individuals classified under the Violence Against Women Act, • Military service members and their spouses and children. The law requires that USCIS officials consider the totality of an individual’s circumstances when making a public charge determination, such as age, income, education and skills, health, family size and affidavits of support (sponsors). Receipt of government assistance is also taken into consideration. Each determination is made on a case-by-case basis and the regional office is not involved in this determination. Specialists will determine eligibility for aliens that are not exempt from the public charge rule following all requirements for Medicaid. 102.05.13 ALIEN STATUS CHART OVERVIEW OF ALIEN ELIGIBILITY FOR MEDICAID VERIFICATION DOCUMENTATION FOR ALIENS SUBJECT TO 5-YEAR DISQUALIFICATION ALIEN STATUS ELIGIBILITY STATUS • I-551 (Alien Registration Receipt Card) commonly referred to as the “green card” • Foreign passport stamped with an un-expired temporary I-551 stamp LAWFULLY ADMITTED FOR PERMANENT RESIDENCE (LPR) LPR is only classification required to have 40 QQ’s after the 5-year disqualification period.
