Ukrainian nationals paroled after September 30, 2023, who are the spouse or child of the parolee above or are the parent, legal guardian or primary caregiver for the parolee above who entered as an unaccompanied minor are also eligible to the same extent as refugees. However, this special group is not subject to the 5-year bar and not limited to 7 years of eligibility. • COFA migrants are considered qualified non-citizens. This classification is not subject to 5-year bar or the 7-year eligibility limit. American Indians born in Canada who meet applicable criteria are regarded as lawful permanent residents. This classification is not subject to the 5-year bar or limited to 7 years of eligibility. NOTE: Aliens filing an application for Emergency Medicaid services only are not subject to either the 5-year disqualification or 7-year time limit. 102.05.06 REQUIREMENT FOR 40 QUALIFYING QUARTERS At the end of the 5-year disqualification period an alien classified as lawfully admitted for permanent residence (LPR) is potentially eligible for full Medicaid benefits only if the individual can be credited with 40 qualifying quarters (QQs) of earnings covered by Social Security or can be credited with 40 QQs which satisfy the requirement. NOTE: If 40 QQs cannot be credited, determine if the alien is exempt due to having grandfathered status or veteran or active-duty military status (including certain family members). Exempt individuals are not required to have 40 QQ’s. If not exempt, the LPR remains potentially eligible for Emergency Medicaid only. All classes of aliens who are subject to the mandatory 5-year disqualification period are not eligible for full Medicaid for the first 5 years, even if they can be credited with 40 qualifying quarters prior to or during the 5-year disqualification period. The disqualification period must be imposed before an assessment of eligibility based on the 40-quarter requirement. Alien classifications of granted parole for at least one year, battered aliens and aliens granted conditional entry are not required to have 40 Qualifying Quarters of coverage in order to qualify for Medicaid but are subject to the 5-year bar.
