IPV is suspected when there is evidence that the client or Child Development and Care (CDC) provider has apparently withheld or misrepresented information for the purpose of establishing, maintaining, increasing or preventing reduction of program benefits or eligibility. FAP Only IPV is suspected for a client who is alleged to have misused or trafficked FAP benefits. Reminder: For OPs originally calculated as suspected IPV that are found to be client error (CE) only, the OP period may change and affect the OP amount. OVERPAYMENT AMOUNT FIP, SDA, RCA, CDC and FAP The amount of benefits issued to the client, household, or provider in excess of what the recipient(s) was/were eligible to receive. FAP Only If the client error involves two or more FAP groups which should have received benefits as one group, determine the error amount by doing the following: • Add together all the benefits received by each group, and • Subtract the correct benefits for the one combined group. Trafficking amount for trafficking related IPVs is the value of the attempted or actually trafficked benefits as determined by: • The court decision. • The individual's admission. • Documentation used to establish the trafficking determination, such as an affidavit from a store owner or sworn testimony from a federal or state investigator of how much a client could have reasonably trafficked in that store. This can be established through circumstantial evidence.
