Volume 2 - Supplemental Nutrition Assistance Program (SNAP) MS 2330 – R. 7/1/26 – OMTL – 701 Exceptions to Student Status

[The following individuals are not considered students or are exempt from student status:

A. Individuals 17 years of age or younger or 50 years of age or older;

B. Individuals who are physically or mentally unfit;

C. Individuals receiving Temporary Assistance for Needy Families (TANF) under Title IV of the Social Security Act;

D. Individuals participating in on-the-job training programs, including paid apprenticeships, are exempt from student criteria during the time they are being trained by the employer. This includes individuals who are placed in an institution of higher education through, or in compliance with the requirements of the program in which they are participating;

Example: An individual enrolled in school to become an electrician and participating in a paid apprenticeship would not be considered a student.

E. Individuals who are employed and paid for an average of 20 hours per week or 80 hours per month, or self-employed and paid for a minimum of 20 hours per week or 80 hours per month and receive weekly earnings at least equal to the federal minimum wage multiplied by 20 hours;

F. Individuals participating in a state or federally financed work-study program during the regular school year;

G. Individuals who are single parents enrolled in an institution of higher education on a full-time basis and are responsible for the care of a dependent child under the age of 12;

H. Individuals attending school less than half-time as defined by the institution;

I. Individuals enrolled full-time in schools and training programs that are not institutions of higher education;

J. Individuals attending high school; and

K. Refugees enrolled only in English as a Second Language (ESL) courses at institutions of higher education. A refugee taking ESL courses as part of a total program must meet one of the student provision requirements if they otherwise meet the definition of a student.]
