(2) deceased, any remaining minors from the benefit group are entitled to any remaining SNAP benefits. If the minors are placed into the care of another individual, that individual may use the remaining benefits issued on the EBT card until they are exhausted. In these situations, if the RCW contacts the individual in possession of the EBT card, they may counsel them on proper card security and use, but an IPV would not be pursued. For more information on processing procedures for when the head-of-household is reported as deceased, reference Volume 2 MS 6732.]
Example 3: Purchasing food with EBT benefits intended for your SNAP household but giving the food to another household.
[Example 4: The recipient is incarcerated from January 1, 2020, through June 30, 2020. During this period of incarceration, the recipient allowed a non-household member access to use their EBT card. If the non-household member had their own historical SNAP case and was informed of the program rules, an IPV is pursued against the non-household member for misuse because they accessed an EBT card to which they did not have ownership of. If the non-household member never had their own historical SNAP case with the agency, an IPV would not be pursued.
In addition, upon the recipient’s release, an IPV will be pursued against them along with a claim for the amount of benefits used by the non-household member during the incarceration period. Once the form FS-80A (TR), Voluntary Waiver of SNAP Administrative Disqualification Hearing, is returned signed or an ADH is received affirming the decision of the agency, a disqualification penalty would be imposed, and the claim would be established on the Benefit Recovery module.]
