MS 1010 (2)
Review for a potential claim if a household contains an ineligible member and they fail to report a change that would make the ineligible member's status change to eligible, causing their income and resources to count towards eligibility. This includes member statuses such as an ineligible student, a member having a work-related disqualification, a fleeing felon, a probation or parole violator, and ineligible immigrants.
G. Disqualified Members
Review for a potential claim if a household containing a disqualified member fails to report a change in income or resources. Disqualified members are those disqualified for an Intentional Program Violation (IPV), a work penalty, enumeration, child support delinquency, or for failure to meet citizenship requirements.
H. Fleeing Felons
Review for a potential claim if a household member has an outstanding felony warrant and received benefits while the warrant was in effect.
I. Simplified Reporting (SR)
1. SR policy was implemented effective February 1, 2002, and includes all cases with earned income, including self-employment.
2. SR policy was expanded effective March 1, 2003, to include all cases except households in which all members are elderly or disabled with NO earned income.
3. SR policy was expanded effective April 1, 2009, to all households.
J. Dual Participation (SNAP)
An overpayment can occur when an individual gives false or misleading information about their identity and/or place of residency in order to receive benefits in multiple states simultaneously. A claim pursued for dual participation requires contacting the other state(s) and obtaining verification that the benefits were issued for the same time period as in Kentucky, and the issued benefits from each state were accessed and used. It is not dual participation if benefits are only accessed in one state.
[Example 1: An individual applies in Kentucky and states they are not receiving benefits in any other state. A report verifies the individual was receiving benefits in another state for the same time period. Verification was received confirming the individual accessed and used the benefits from the other state at the same time the individual was receiving and using benefits in Kentucky. This would be explored as a Dual Participation Claim and pursue the associated Intentional Program Violation (IPV) disqualification.
