MS 0870 (4)
was not completed by the landlord. In the claim, it is notated that the individual returned false verification, as the landlord did not complete the PAFS-76.
Example 2: The case record contains form PAFS-700 from the individual’s employer. The employer can be contacted to verify information pertaining to an individual’s employment but is not to be questioned about the individual’s living situation.
Example 3: An individual applied for SNAP benefits on 3/21/2023. Over the course of their certification period, the employment reported at the application ended with the last pay received in June 2023. The individual never reported the change to the agency, and the income continued to count in the case. A claim referral was submitted after the recertification interview for a potential overpayment due to the individual starting new employment on 6/15/2023, and the household failed to report exceeding the gross income limit by 7/10/2023. During the claim investigation, the RCW should attempt to verify the income and termination through the use of form CL-700, Verification of Employment and Wages, a collateral contact, or other acceptable forms of verification. The RCW should not consider terminated income in claim calculations if they are able to obtain verification of the termination and final wages, even when the termination is not reported by the household. Claim calculations utilize the household’s actual income received during a benefit month when determining if an overpayment of benefits occurred.]
L. If verification of the claim cannot be substantiated by any available source, determine if the claim should be referred to OIG for further investigation. If the claim does not meet the criteria for a referral to OIG, then no claim exists. If information later becomes available to establish the claim, it can be reentered as a potential claim on the Benefit Recovery Module.
M. Potential fraud claims that meet the criteria in MS 0910 are referred to OIG for further investigation. If a disability exists or Limited English Proficiency (LEP) is present, prior to completing a referral to OIG, seek an assessment of the individual’s ability to understand program rules from the Department of Community Based Services (DCBS) Equal Employment Opportunity (EEO) Coordinator or Cabinet for Health and Family Services (CHFS) EEO Compliance Branch, 275 East Main Street 5 C-D, Frankfort, KY 40621 or call 502-564- 7770.
[N. State Supplementation potential claim referrals are sent directly to the Medical Support and Benefits Branch (MSBB):
1. If detection is made by field staff for a potential State Supplementation claim, a manual claim referral is submitted on the Benefit Recovery module within the Benefit Management tab.
