amended by changing Sections 10-5, 10-10, 10-25, 10-30, 10-35, 10-37, 10-38, 10-45, and 10-50 and by adding Section 10-24 as follows: (35 ILCS 143/10-5) Sec. 10-5. Definitions. For purposes of this Act: "Actual cost" means the actual price paid for each individual SKU by a distributor or a remote retail seller before any stated discounts or rebates. "Actual cost list" means the average actual price paid for a SKU by a distributor or a remote retail seller, before any stated discounts or rebates, to a manufacturer, wholesaler, or distributor during the calendar year immediately preceding the calendar year in which the sale occurs. "Alternative nicotine product" means a product that does not consist of or contain tobacco and that provides for the ingestion into the body of nicotine, whether by chewing, smoking, absorbing, dissolving, snorting, or sniffing. "Alternative nicotine product" does not include electronic cigarettes, as defined in this Act, or any product that is approved by the United States Food and Drug Administration for sale as a tobacco cessation product, as a tobacco dependence product, or for other medical purposes and that is being marketed and sold solely for that approved purpose.
