Basic Considerations
To be eligible under the Former SSI-Disabled Child COA, the A/R must meet the following conditions:
The A/R was receiving SSI as a disabled child on August 22, 1996, and was terminated as a result of SSA’s new definition of disability. This includes those SSI A/R’s who, as of August 22, 1996: The A/R was receiving SSI as a disabled child on August 22, 1996, and was terminated as a result of SSA’s new definition of disability. This includes those SSI A/R’s who, as of August 22, 1996: were in current pay status; or received a favorable or partially favorable administrative decision from SSA; or were terminated due to non-cooperation with the disability redetermination process of SSA; or had a Zebley appeal pending.
The A/R would be eligible for SSI but for the passage of the new disability decision.
The A/R continues to meet all basic and financial eligibility criteria for SSI.
Length of Stay (LOS) and Level of Care (LOC) are not requirements for this COA.
