ESA SNAP Policy Manual 215 inform the household before its next issuance date, ESA will not delay terminating the household’s participation in order to provide advance notice.  ESA initiates recoupment of a claim against a household that has previously received a Notice of Adverse Action with respect to such claim. Legal Authority Exceptions to timely Notice of Adverse Action (District): All: DC Official Code § 4–205.55(b) Exceptions to timely Notice of Adverse Action (federal): SNAP: 7 CFR § 273.13(b) 16.7 Notice of Denial SNAP households found to be ineligible will be sent a Notice of Denial as soon as possible but not later than 30 days following the date the application was filed. The notice must contain the following:  Explanation of basis for denial  Right to request a fair hearing  Telephone number of SNAP office: either local office or statewide number  Name of SSR to contact, if available  Name and contact information for organization that provides free legal services, if available  For categorically eligible households, request for the household to notify the SNAP office if it is approved for public assistance, general assistance or SSI benefits  When a delay occurred because the household failed to take action to complete the application process, the notice must advise the household of actions it must take to reopen its application, that the case will be reopened without a new application if action is taken within 60 days of the date of the application and that failure to do so means the household must file a new application to participate Legal Authority Notice of Denial (federal): SNAP: 7 CFR § 273.10(g)(1)(ii), 7 CFR § 273.2(h)(2)(i)(A) 16.8 Notice of Interview Requirement For SNAP households that do not complete an interview on the day their application is submitted, ESA must notify the household of the interview requirement and its options for completing the interview.
