ESA SNAP Policy Manual 137 for SNAP deeming purposes. However, ESA must limit allowable reductions to the total gross income of the sponsor and the sponsor’s spouse prior to attributing an income amount to the noncitizen to amounts specified in the two bullets above. ESA must consider as income to the noncitizen any money the sponsor or the sponsor’s spouse pays the eligible sponsored noncitizen but only to the extent the money exceeds the amount deemed to the eligible sponsored noncitizen as determined above. Where applicable, ESA must deem as available to the eligible sponsored noncitizen the total amount of the resources of the sponsor and sponsor’s spouse, reduced by $1,500. If a sponsored noncitizen can demonstrate that their sponsor is the sponsor of other noncitizens, ESA must divide the income and resources, where applicable, deemed under the provisions of this section by the number of such sponsored noncitizens. Deeming income does not apply to the following individuals: A noncitizen who is a member of their sponsor’s SNAP household A noncitizen who is sponsored by an organization or group instead of an individual A noncitizen who is not required to have a sponsor under the Immigration and Nationality Act, such as a refugee, a parolee, an asylee or a Cuban or Haitian entrant An indigent noncitizen who ESA has determined is unable to obtain food and shelter, taking into account the noncitizen’s own income plus any cash, food, housing or other assistance provided by other individuals, including the sponsor(s). Prior to determining whether a noncitizen is indigent, ESA must explain the purpose of the determination to the noncitizen and/or household representative and provide the noncitizen and/or household representative the opportunity to refuse the determination. − If the household refuses the determination, ESA will not complete the determination and will deem the sponsor’s income and resources to the noncitizen’s household per instructions in this section. ESA must inform the sponsored noncitizen of the consequences of refusing this determination.
