ESA SNAP Policy Manual 120 Employment is offered on a piece-rate basis, and the average hourly wage the employee can reasonably expect to earn is less than the District’s minimum wage. The household member is required to join, resign from or refrain from joining a legitimate labor organization to be hired or to continue working. The work offered is at a site subject to a strike or lockout at the time of the offer, unless one of the following has occurred: − A judge has enjoined the strike under section 208 of the Labor-Management Relations Act (Taft-Hartley). − A judge has issued an injunction under section 10 of the Railway Labor Act. The job has an unreasonable risk to health and safety. The member is physically or mentally unfit to perform the work, as documented by medical evidence or reliable information from other sources. The employment offered within the first 30 days of work registration is not in the household member’s field of experience. The place of employment is an unreasonable distance from the person’s home based on the expected wage and the time and cost of commuting: − Daily commute time must not exceed two hours per day, not including transportation of a child to and from the childcare facility. − Employment is not considered suitable if the distance to the place of employment prevents walking to the job site and both public and private transportation are unavailable to get to the job site. Working hours or the nature of employment interferes with the member’s religious observance, convictions or beliefs. Employment, an offer of employment or activity discriminates based on one of the protected traits under the DC Human Rights Act. Accepting work may result in domestic violence. Example Mr. Taylor is a Sabbatarian and refuses to work on Saturday. His religious observance will not affect his eligibility, and he is not required to accept a job with Saturday hours.
9.3.6 SNAP Disqualification for Failure to Meet Work Requirements If a nonexempt individual member of the household subject to SNAP General Work Requirements (GWR) fails to meet the work requirements without good cause, they are ineligible for SNAP until one of the following dates, whichever is later: ESA determines they have complied with work requirements. They have completed the appropriate disqualification period (see Table 9.3.6, Disqualification Periods per Violations). Return
