ESA SNAP Policy Manual 108 individual who is claimed or could be claimed by the sponsor(s) as a dependent for federal income tax purposes. Divide the result by the number of sponsored noncitizens. Multiply the result by the number of sponsored noncitizen adults applying for SNAP benefits. The result of this calculation is the sponsors’ deemed income amount. 8.6.5.6 Deemed Assets From a Sponsor The assets of a sponsor(s) that will be deemed to the noncitizen are calculated as follows: Add the sponsor’s countable assets together. Subtract $1,500 from the result. Divide by the number of sponsored noncitizens. Multiply the result by the number of sponsored noncitizen adults applying for SNAP benefits. The result of this calculation is the sponsor’s deemed asset amount. 8.6.5.7 Request for Reimbursement ESA must request reimbursement from sponsors who have signed the I-864 for the value of any benefits received by the sponsored noncitizen during the period the affidavit is in effect. It is not required to pursue legal action, however, if the amount of the liability is not paid. ESA must notify households that contain noncitizens who are subject to deeming that the noncitizen’s sponsor may be liable for the amount of benefits the sponsored noncitizen receives while the affidavit of support is in effect. ESA cannot request reimbursement from the sponsor for any period that the sponsor received SNAP. If the sponsor stops receiving SNAP, the sponsor is still not liable for the benefits received by the sponsored noncitizen during the period the sponsor also received SNAP. 8.6.6 Determining Whether a Noncitizen Entered the US on or Before August 22, 1996 Some qualified noncitizens are eligible for benefits only if they entered the US before August 22, 1996. This includes people who are currently qualified noncitizens who resided in the US on or before August 22, 1996, but did not have a qualified status at that time. Some qualified noncitizens who entered after this date are ineligible for these benefits during their first five years in the US. To determine whether the qualified noncitizen entered the US before August 22, 1996, ESA must review immigration documents and printouts obtained through SAVE (see Section 5.4.2.1, SAVE). If these documents do not indicate whether the noncitizen entered before August 22, 1996, ESA must request the individual to provide additional documentation that can establish whether they were physically present in the country on or before August 22, 1996.
