However, if the individual adjusts to qualified noncitizen status, such as LPR or battered noncitizen status, the individual could potentially be eligible to receive SNAP. 8.6.4 Verification of Noncitizenship Status ESA must verify eligible immigration status of all noncitizen household members applying for SNAP. For acceptable verification of noncitizenship status, see Section 5.4.2, Noncitizenship. SAVE is a system operated by the US Citizenship and Immigration Services (USCIS) to electronically verify immigration status. ESA uses SAVE to verify the initial documentation of immigration status received from the household (see Section 5.4.2.1, SAVE, for additional information on this process). If a noncitizen does not want ESA to contact USCIS to verify their status, ESA must give the household the option to withdraw the application or participate without the noncitizen member. SNAP regulations require State application forms to provide a statement allowing applicants to attest, under penalties of perjury, to the citizenship status of the members applying for benefits. This attestation of US citizenship is generally sufficient for SNAP purposes unless questionable. If a household member is unable or unwilling to provide documentation of immigration status for themselves or for any household member, ESA must take the following actions: Show that person and/or the household member as an ineligible noncitizen. Stop efforts to obtain such documentation.
