ESA SNAP Policy Manual 98 8.5.3 Response Time ESA allows law enforcement agencies 20 days to respond to a request for information about the conditions of a felony warrant or a probation or parole violation and whether the law enforcement agency intends to actively pursue the individual. If the law enforcement agency does not state that it plans to enforce the felony warrant or arrest the individual for the probation or parole violation within 30 days of the date of ESA’s request for information about the warrant, ESA determines that the individual is not a fleeing felon or a probation or parole violator and documents this in the case record. If the law enforcement agency states that it plans to enforce the felony warrant or arrest the individual for the probation or parole violation within 30 days of the date of ESA’s request for information, ESA must postpone taking any action on the case until the 30-day period has expired. Once the 30-day period has expired, ESA must verify with the law enforcement agency whether it has attempted to execute the felony warrant or arrest the probation or parole violator. − If the agency has attempted to execute the warrant or make an arrest, ESA must deny the application or terminate benefits for the participant who is considered a fleeing felon or a probation or parole violator. − If the agency has not taken any action within 30 days, ESA does not consider the individual a fleeing felon or probation or parole violator. ESA should document this information in the case record and take no further action. 8.5.4 Application Processing While Awaiting Verification ESA must continue to process the application while waiting for proof of fleeing felon or probation or parole violator status from law enforcement. ESA must process the application without considering the fleeing felon or probation or parole violator status if waiting for the proof would cause the application to be processed untimely. 8.5.5 Certain Convicted Felons The following individuals are not eligible for SNAP: The individual who, as an adult, is convicted of: − Federal aggravated sexual abuse − Murder − Sexual exploitation and abuse of children − Sexual assault The individual who is not complying with their sentence terms
