P-1570.25 1. Determine the reason for the Fair Hearing request.

2. If the Fair Hearing is being requested because the requester considers the computed CSPA to be insufficient to maintain adequate income, stop here and go to P-1570.30 - Adjustment of CSPA.

3. If the Fair Hearing is being requested because the requester considers the computation of the CSPA to be incorrect, go to step 4.

4. Obtain a Fair Hearing summary with:

° a copy of the request for the assessment.

° a copy of any documentation used for the assessment.

5. Determine the assets which were owned by both the community spouse and the institutionalized spouse at the beginning of the continuous period of institutionalization.

6. Evaluate each asset owned by either or both spouses according to the policy in section 4000 - "Treatment of Assets." Do not require either spouse to pursue inaccessible assets.

7. Compute the total value of all counted assets owned by the institutionalized spouse by adding the equity value of all his or her non-excluded accessible assets.

8. Compute the total value of all counted assets owned by the community spouse by adding the equity value of all his or her non-excluded accessible assets.

9. Add the amounts computed in steps 7 and 8.

P-1570.25 10. Divide the amount calculated in step 9 by 2 to determine The spousal share for each spouse.

11. Determine the amount of the CSPA by using the policy at 4022.05.

12. Render a decision based upon the result of step 11.
