Editor’s note: As of Register 171 (October 2004), and acting under AS 44.62.125(b)(6) and sec. 12, ch. 107, SLA 2004, the regulations attorney made technical changes to reflect the name change of the child support enforcement agency to the child support services agency made by sec. 1, ch. 107, SLA 2004. Effective July 1, 2022, Executive Order 121 split the former Department of Health and Social Services into the Department of Health and the Department of Family and Community Services. As of Register 242 (July 2022), the regulations attorney made conforming technical revisions under sec. 138, E.O. 121 and AS 44.62.125(b)(6), to 7 AAC 80.100. In addition, the regulations attorney made conforming changes to the authority citation to add references to AS 44.30.020, 44.30.030, and AS 47.06.010. 7 AAC 80.110. Public interest waiver. (a) The department may waive a fee for a social service if the commissioner determines that collecting the fee interferes with the departmental purpose of providing services to protect children and to rehabilitate or reunite families. (b) No child who has been placed in the legal custody of the department will be denied available and necessary social services because of the family’s inability to pay for those services.
